Scene 1
Kevin Kinkirk and his wife Lucy arrive
at the Ross and Cooper law office.
KEVIN
Our Daughter Savannah was run over and killed
by a motor vehicle when she was walking home from
school on a narrow sidewalk.
COOPER
Are you sure that you want to sue ?
the maximum liability on personal
injury or wrongful death is
$ 250000.00 in Californias courts
and we charge a $50000.00 up front
startup fee on personal injury
cases to cover expenses.
LUCY
the survelence video that we purchased
from a nearby business clearly shows a
parked car on the narrow sidewalk
running over Savanna after starting up to
leave.
Savanna could not get out of the way because
the narrow sidewalk is up against a barbed wire
fence and the street with 35 MPH traffic is on
the other side of that narrow sidewalk.
Savanna was crushed under the wheel and
killed.
DAVID ROSS
If Savanna had been run over in the street
the $ 250000.00 state limit would apply
to limit automobile liability insurance
rate increases because it would have been
just a simple accident if in the street --
But if any driver runs over or hits any
pedestrian anyplace outside the street
designed for vehicular traffic that injury
to or death of the pedestrian is considered
a violation of that pedestrians civil rights.
Savannas civil rights were violated
when she was run over by a driver
who was driving on the sidewalk.
KEVIN
Here is a check for $450000.00 to partially
cover startup expenses.
Kevin gives Mr. Cooper a $450000.00 check.
LUCY
We want to make sure that Savanna gets
justice.
(Scene 2)
David Ross and Mr. Cooper arrive at court and
ask the federal judge for a jury of 12 volunteers.
The judge explains that we do not have that yet.
(Scene 3)
The federal civil trial begins.
The survelience tape is played and Savanna
is trying to walk home from school.
The sidewalk is very narrow and a car starts to drive
on the sidewalk after having been parked there.
The fence will not allow Savanna to get out of the way
of the car. There is 35 MPH continous traffic on the
other side of the narrow sidewalk from the fence.
The driver is busy with a cell phone while driving on
the sidewalk and is unable to hear savanna scream.
The cars windows are all rolled up.
Savanna goes underneath the cars wheels near the fence
and is crushed.
ATTORNEY DAVID ROSS
We believe that Savannas civil rights were
violated because she was run over and severly
injured or killed by a driver that was driving
on the sidewalk instead of the street.
Pedestrians should be able to expect
to be safe on the sidewalk. Cars need
to stay IN THE STREET !!!!!!!!

Then the insurance company lawyer offered
to settle for $250000.00 and mumbled that
nobody walks in California and the
driver was busy with an
important phone call for a
postponement of an eviction notice that
the rent check will be written soon.
a new job had just been started.

(scene 4)
David Ross and Mr. Cooper are sitting and
waiting outside the courtroom with Kevin
and Lucy.
Then they go back in the courtroom with the
jury.
The jury foreman hands the verdict form to
the judge. Then additional media crews
show up.
Then the verdict is read.
We the jury find both the driver and the
insurance company who insured the driver
guilty of severly violating Savannas
federal civil rights. The award is 36 billion
dollars.
Then the judge checks the insurance company
financial statements and orders the now
bankrupt insurance company closed and all
policies are canceled and all employees
are laid off.

(Scene 5)
Attornies David Ross and Mr. Cooper are
in the insurance commissoners office.
INSURANCE COMMISSONER
Your court case is going to raise
everybodys auto liability insurance rates.
36 billion dollars is 144000 times as
much as the regular 250000
dollar maximum liability
for car accidents.
MR. COOPER
Driving on the sidewalk is a serious
crime that needs to be severly punished.
DAVID ROSS
If you will allow insurance companies to
increase rates on every driver caught driving
on or parking on a sidewalk even before getting
into an accident then good drivers who keep their
cars in the street at all times will still be
able to afford auto liability insurance.
INSURANCE COMMISSIONER
The new rule is that any vehicle that is caught
parked on a sidewalk or any driver caught driving
anyplace except the street can have their
auto liability insurance rates doubled
for a seven year period even if there is no
accident!!!!!!!
MR. COOPER
If anyone who has a camera sees a car parked
on a sidewalk they can take a picture of it with
its liscence plate number in the picture that
shows that vehicle on the sidewalk and send
that picture to their own insurance
company or the DMV or law enforcement office.
Then that place will access the
DMV database and find out who the registered
owner of that vehicle is. Then the information
will be forwarded on to that persons insurance company
that will double the insurance rate for seven years.
A copy of the picture will be sent to the owner
of the vehicle along with the notice of insurance
rate doubling for seven years. If that is unaffordable
that vehicle owner will have to sell their
vehicle and stop driving for seven years.
DAVID ROSS
Even if there are no police it is still against
the law to drive on or park on any sidewalk and
violaters will be reported to the insurance
companies.
Beginning on September 5, 2006 any vehicle
caught parked on any sidewalk or any driver
caught driving anyplace except the street
shall have their auto liability insurance
rates doubled for seven years even if
there is no accident!!!!!!!
