Fmr. Reserve Officer Sentenced

A former Rankin County reserve deputy is headed to Parchman for sexually
molesting a minor.
Bobby J. Malley's sentencing came after heartfelt testimony from the
child's mother and efforts by the District Attorney's office to
prosecute him for breaking public trust.
The mother of the now-14-year-old boy choked back tears as she said
Malley's sexual molestation of her son caused him untold pain. The
Rankin county woman gave her testimony Monday during the sentencing
hearing. "My son was the victim of a pedophile," she said. "I resent the
fact that my son's innocence was taken away from him. I resent the fact
that my son wonders about his sexuality."
Malley was a 10-year Rankin County reserve officer and director of the
Reserve Officer Law Enforcement Training Academy.
He pleaded guilty in late October to two counts of molesting a minor.
The molestation happened in February and March of 2003.
The 60-year-old former law officer made no statement during sentencing,
but his attorney Chris Tabb requested another continuance because
Malley's wife has been diagnosed with colon cancer.
"The initial chemotherapy would probably go much better if Mr. Malley
was home," Tabb said. "So we would ask that this sentencing be continued
for a period of two months."
"It's going to be a hardship on the victim, who was 11 at the time of
the offense," said Rankin County Assistant District Attorney Jamie
McBride. "His family -- we need closure, Judge. We ask to go forward today."
Rankin County Sheriff Ronnie Pennington said Malley was removed from his
position when allegations were brought to his department.
The D.A.'s office recommended an eight year sentence, 12 years
suspended, with five years supervised probation.
"This is one of the kind of crimes, I believe, that permeates through
society," said Judge William Chapman III. "Mr. Malley, you were in a
position of trust."
The judge said if it were in his power he would order Malley have no
further contact with children.
The boy's mother said Malley was a trusted family friend who she could
not forgive, but she wanted to speak out for others. "My son is not the
first victim, but hopefully my son is going to be the last victim," she
said.
Malley is being held at the Rankin County Detention Center and will soon
be transferred to Parchman.
Rankin County District Attorney David Clark says his office has
vigorously prosecuted child abuse cases, and this is an example.
