Alert jogger stops pedophile suspect

When Steve Foster noticed a young boy taking his clothes off next to
Spring Creek late last month, he thought maybe the boy was going to
play in the stream on a nice day.
However, when he saw the older man across the creek, he knew something
was wrong.

Foster was jogging along Spring Creek Trail near Edora Park in the
early afternoon of March 28 when he saw, farther down the stream, the
young boy with his shirt off. As he got closer, Foster saw the boy
pull his pants down, but he pulled them back up when he noticed Foster
approaching.
"It just didn't seem quite right," Foster said.
As he got even closer, Foster saw an older man sitting across the
stream, watching the boy.
"It hit me then that it was all wrong," he said.
Foster, the father of two and a Sunday school teacher, doubled back
and began talking with the boy, who was joined by the man identified
by police as John Mark Smith, 43.
The boy kept saying, "You're scaring him," Foster said.
At one point, Smith stood up and his own pants fell down, Foster said.
As the event unfolded, Foster ran to some groundskeepers at the park
and asked them to call police. He then went back and stopped Smith
from riding off on a bicycle and kept him there until police arrived.
"Something wasn't right in his eyes," Foster said.
When the boy's mother arrived on scene, Foster said she came up and
thanked him.
"I shook her hand and told her to go love on (the boy)," he said.
Smith was questioned at the scene and released, said Fort Collins
police Lt. Hal Dean.
The boy was later interviewed at the Larimer County Child Advocacy
Center. The advocacy center is a facility that specializes in working
with children who are the victims of abuse and neglect.
During the interview, the boy said he met Smith at the park that day,
Dean said, adding there is no evidence that Smith ever touched the
boy.
Police arrested Smith on Wednesday near the Coloradoan mailroom at
1212 Riverside Ave. Smith is an independent contractor who delivered a
weekly publication produced by the paper.
Smith, who now faces one count of enticement of a child, remains
jailed with bond set at $25,000. He is scheduled to make his first
appearance in District Court at 8:30 a.m. Thursday.
