I hope and pray that none of you ever need to know this, but you
should know it -- and you should tell everyone you know and love. And
maybe even those you don't.
I'm sure that most of you are familiar with the Fifth Amendment
protection against incriminating yourself in some way or another.
Basically it says that you can not be compelled to give evidence
against yourself, but there are several tricky wickets to it already.
The first thing is that if you agree to testify on your own behalf,
the prosecution has -- and should have -- the right to cross
examination, meaning you can plead the fifth when you've agreed to
testify. There may be some areas where there is some give and take
here, but you especially cannot plead the fifth regarding statements
you have already testified to in court under oath. If they can find a
contradiction in your testimony and previously given statements, they
can question you about that. Recent arguments regarding interpretation
have decided that passwords are not subject to this protection. In
other words, if they find password-protected files on your hard-drive
or on any kind of media, you cannot plead the Fifth Amendment. You
either have to provide the password or face the possibility of being
found in contempt of court, for which the judge may impose jail time
until you have cooperated with the court's request for your password.
But the newest interpretations are really going to get you. First,
they don't have to warn you about the fact that you have the right to
remain silent and that anything you might say can and will be used
against you in a court of law. This very cozily circumvents the
Miranda Laws enacted a while back which required police to inform you
of your rights before interrogating you. Eventually, they will have to
tell you your rights, but if you should say something incriminating
before that, you're fucked. Even worse, if you do not declare that you
are exercising your rights, they can treat you as a hostile witness.
So simply remaining silent isn't enough -- the court will now try to
use your silence against you if you don't declare that you are
exercising your Fifth Amendment right to remain silent. And since this
all can occur before you are warned of your rights, this includes any
kind of questioning the police give you. Say, you let them in to ask a
few questions about something and you have no answer for one of the
questions -- you need to state either you don't know or that you are
exercising your right to remain silent. And you need to keep in mind
that, since this can happen before you are apprized of your rights,
the police can basically use any trick in the book that they want to
use against you. Remember that you always have the right to legal
representation and you always have the right to remain silent -- but
now you absolutely need to tell the police that you are claiming your
rights. A simple statement like, "I will help you and cooperate in
whatever ways I can, but I understand that I have the right to remain
silent, and that I have the right to legal representation at any time
I should ask for it." And then remind them again if they ask a
question you cannot answer. Remember, "I don't know" is an answer, and
one you should not hesitate to give!

Editorial: it's becoming increasingly clear, while the Republicans may
want your vote, they don't want you in their club if you're not white,
very rich, allegedly-Christian and male. So far they have fought to
make sure that the rich stay rich while the poor get screwed -- as
evidenced by their fight against making rich people and corporations
pay their fair portion of taxes, and their fights against Obamacare --
which is working and paying for itself -- and Social Security, which
is also paying for itself and is a matter of money paid into the
system being returned to the people who paid it in in the first place,
and their childish attempts to hold the government hostage by
threatening to shut it down if they can't get their way. They have
fought against women by trying to deny access to necessary medical
maintenance care -- especially to the poor, their on-going fight
against choice and their on-going refusal to provide equal pay for
equal work. They have declared war on Homosexuals through their
ignorant stand against marriage equality (note: if you're rich enough,
you can meet other men in the Teahouses of the Interstates to blow all
comers -- after all, boys will be boys! -- so long as you're not one
of them homasexshals!). And while they give lip-service to freedom of
religion, why were they making such a big deal claiming that Obama was
actually a Muslim? The only thing that scares me is that so many
idiots are willing to vote for them! Seriously, does anyone get hurt
by having their police records and mental health records checked
before they're allowed to buy a gun? How exactly does that interfere
with the right to own a gun? And does anyone really need assault
weapons to protect their home or to go hunting? And would there be
enough of a carcass left to harvest for food? I'm all for hunters, God
Bless 'em. Most of them teach they're kids how to be safe around guns
and they donate food to the poor -- and I mean damn good food, too!

Yeah, they'll kiss your ass for a vote and use every lie in the book
to get your vote, but if you're not white, rich, straight or closeted
with a lot of money to throw around, pretend to be a Christian and
male, they don't want you in their clubhouse. Unless you're a dancing
girl (or boy!).
