Anything you can see with your eyes without special zoom is legal to
photograph. That creates an unregistered copyright. You have no legal
right to change original intent of copyright holder. Intent can be
inferred by setting of the picture/video. As photographer I have
creative license as long as not defamatory, illegal, or obscene. If not
the photographer you may only reproduce in fashion of original without
comercial gain. By adding comments to original works you create cp if
you will. Coents by theselves are protected by the First Amendment but
attaching them to an original work of someone else creates porn
